Terms of Service
The agreement between you and omo when you use omo.finance.
Last updated 27 September 2026.
1. About these terms
These Terms of Service are an agreement between you and omo ("omo", "we", "us"). They cover your use of omo.finance, its documentation, and any interface we provide to the omo protocol (together, the "Site").
By using the Site, connecting a wallet, or signing a transaction built by the Site, you agree to these terms. If you do not agree, do not use the Site.
2. What omo is
The Site is an interface to software that runs on the Solana blockchain (the "Protocol"). The Protocol lets users mint and redeem fUSD against USDC, and borrow USDC against collateral.
The Site does not hold your funds. You control your wallet and your keys. Every action is a transaction that you review and sign yourself.
omo is an independent project. It is not affiliated with, endorsed by, or operated by FOMO, Circle, Whop, Solana Foundation, or any other third party named on the Site.
3. Who may use the Site
You may use the Site only if all of the following are true:
- You are at least 18 years old and able to enter into a binding agreement.
- Using the Site is lawful where you live.
- You are not the subject of sanctions, and you are not located in, or a resident of, a country or region subject to comprehensive sanctions.
- You are not using the Site on behalf of someone who does not meet these conditions.
We may restrict access to the Site from any location at any time.
4. Your wallet
You are responsible for your wallet, your keys and your seed phrase. We never have access to them and cannot recover them.
Transactions on Solana are final. We cannot reverse, cancel or refund a transaction once it is confirmed.
You are responsible for checking every address and every amount before you sign.
5. fUSD
fUSD is designed to be minted one to one against USDC and redeemed one to one for USDC through the Protocol. Redemption depends on the Protocol holding enough unlent USDC at that moment.
fUSD is not a bank deposit. It is not legal tender. It is not insured by any government or deposit protection scheme. It is not issued by a bank or a regulated payment institution.
The value of fUSD depends on USDC, on the Protocol working as intended, and on borrowers repaying or being liquidated. It may lose value.
6. Yield
Any rate shown on the Site, including "up to 16.4% APY", is an estimate or an upper figure. Rates are variable and depend on borrowing demand. They can fall to zero.
We do not promise or guarantee any return. Past or tested rates do not predict future rates.
7. Borrowing and liquidation
When you borrow, you post collateral. If the value of your collateral falls so that your loan is no longer sufficiently covered, anyone may liquidate the loan. You can lose some or all of your collateral.
Interest accrues for as long as a loan is open. Rates and limits can be changed and apply from the time of the change.
Prices used by the Protocol are provided by a price service that we operate. Prices can be late or wrong. You accept this risk.
8. The omo card
The omo card is provided by Whop and its partners, not by omo. Your use of the card is subject to their terms, their identity checks, and their fees and limits.
We do not control whether Whop approves you for a card, and we are not responsible for the card service.
Where the Site shows a card in preview, the card details shown are samples and cannot be used to pay.
9. The $OMO token
$OMO is a token associated with the Protocol. It is not a share, a security, a deposit, or a claim on omo or on the fUSD reserve. Its price is set by the market and it can lose all of its value.
10. Risks
Using the Protocol involves serious risk, including:
- Software risk. The Protocol may contain bugs. It has not been audited by a third party.
- Market risk. Tokens can lose value quickly.
- Liquidity risk. Redemptions may be limited while reserves are lent.
- Price risk. Prices used by the Protocol can be wrong or late.
- Key risk. Administrative keys can change parameters and upgrade the Protocol, and could be compromised.
- Third party risk. USDC, Solana, wallets, Whop and data providers can fail or change.
- Regulatory risk. Laws may change and may affect your ability to use the Site.
You should only use funds that you can afford to lose. Read the Risks page in the docs.
11. No advice
Nothing on the Site is financial, investment, legal or tax advice. Information on the Site, including market data, charts and rates, is provided for information only and may be inaccurate or out of date.
You are responsible for your own decisions and for any tax that results from them.
12. What you must not do
- Use the Site for anything unlawful, including money laundering, terrorist financing or evading sanctions.
- Interfere with the Site, probe it for weaknesses without our permission, or attempt to gain access you are not given.
- Use automated means to overload the Site or to scrape it in a way that harms it.
- Misrepresent your connection with omo, or create tokens or sites that imitate omo or fUSD.
- Manipulate prices or markets that the Protocol relies on.
13. Intellectual property
The Site, its design, text and graphics belong to omo or its licensors. You may use the Site for its intended purpose. You may not copy or reuse our name or branding in a way that suggests you are omo.
Names and logos of third parties belong to their owners and are used to identify them.
14. Third party services
The Site relies on and links to services that we do not control, including wallet providers, Dynamic, Whop, GeckoTerminal, Meteora, Solana RPC providers and block explorers. Your use of them is subject to their terms. We are not responsible for them.
15. No warranty
The Site and the Protocol are provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind, whether express or implied, including that the Site will be available, accurate, secure or free of errors.
16. Limitation of liability
To the fullest extent the law allows, omo and its contributors are not liable for any indirect, incidental, special or consequential loss, or for any loss of funds, tokens, profits or data, arising from your use of the Site or the Protocol.
Where liability cannot be excluded, it is limited to the greater of 100 US dollars or the fees you paid to omo in the twelve months before the claim.
Nothing in these terms limits liability that cannot be limited by law.
17. Indemnity
You agree to cover omo and its contributors for claims and costs that result from your breach of these terms or your unlawful use of the Site.
18. Changes
We may change the Site, the Protocol and these terms. When we change these terms we update the date at the top. If you keep using the Site after a change, you accept the new terms.
We may suspend or stop the Site at any time. The Protocol runs on Solana and may remain usable through other interfaces.
19. Governing law and disputes
These terms are governed by the laws of the place where the operator of omo is established, without regard to conflict of law rules. Before starting any formal claim, you agree to contact us and try to resolve the matter informally for at least 30 days.
If any part of these terms is found to be unenforceable, the rest remains in force.
